Choice between Replacement, Repair, Price Reduction or Termination of Contract
If you are entitled to the legal guarantee, you have several options.
You are initially entitled to choose between a free replacement or repair of the defective good. The repair must be carried out completely free of charge. That means you may not be charged for labour or shipping. Both the replacement and repair must be carried out within a reasonable time frame to avoid causing you significant inconvenience.
If the repair or the replacement is impossible or would impose excessive costs on the seller, you are entitled to request a price reduction or even cancel the sales contract. Is it a minor defect? In that case, cancellation of the sale is not possible. It is the seller's responsibility to prove that the defect is minor.
You can also demand a price reduction or termination of the contract:
- If the seller refuses to repair or replace the good
- If a defect reoccurs despite the previous repair attempt
- If the defect is so serious as to justify immediate price reduction or termination
- If it is apparent that the seller cannot carry out the repair or replacement within a reasonable time or without significant inconvenience to you
