Delay of Works by a Contractor
A contractor must adhere to the deadline specified in the contract for the completion of work. However, this period may be extended in cases of force majeure, adverse weather conditions, or by mutual agreement.
If the deadline is missed, you have the option to send the contractor a registered notice of default. In that letter, you should request that the contractor complete the work within a new, feasible, and reasonable time frame.
Should the contractor fail to perform the work again as agreed, you are, in principle, entitled to rescind the contract. Additionally, you are entitled to claim damages for the contractor's failure to fulfil contractual obligations.
