Unilateral Modification of the Terms of an Energy Supply Contract
As a general rule, the energy supplier may not make unilateral changes to the contract. However, the general terms and conditions of energy supply contracts typically include a clause allowing the supplier to propose revisions to the terms. These review clauses are subject to specific conditions.
Fixed-Term Supply Contracts
The supplier must adhere to the agreed duration of the contract and therefore cannot propose a revision under threat of terminating the contract early.
Indefinite Duration Supply Contracts
For indefinite duration contracts, the energy supplier may propose a revision of the contract, provided that you, the customer, can terminate the contract free of charge within a reasonable period if you do not agree with the revised conditions.
However, some indefinite duration energy contracts include a fixed price guarantee or an indexation clause for a specified term. These terms must, of course, be honoured. Therefore, it is important to review the terms of your contract to understand how they apply to you.
