Package Holiday: Trip Does Not Go as Agreed (e.g. No Sea View, No All Inclusive)
If you have booked a package holiday and something goes wrong, you should report it to the tour operator or travel agency as soon as possible. They are responsible for the proper execution of your package holiday.
The tour operator or travel agency has to find a solution. If they do not, you may do it yourself and request reimbursement.
You have the option to refuse proposed solution if it does not match the agreed terms in the package holiday contract or if the price reduction offered is inadequate.
If the tour operator does not offer a solution or you reject that proposal, you can cancel the package holiday without compensation and request damages. In addition, if the package holiday includes passenger transportation, the organiser also provides for your repatriation with equivalent transportation, without undue delay and without additional costs.
If extraordinary and unavoidable circumstances prevent your return, the tour operator will also bear the cost of your accommodation for a maximum of 3 nights.
The tour operator's obligation for persons with disabilities, pregnant women, unaccompanied minors, and those needing special medical assistance is not restricted to 3 nights' accommodation.
