Commercial Guarantee

Have you purchased a product (such as a car, fridge, furniture, smartphone, clothes, etc.)? Then the seller must provide a guarantee for up to two years after delivery if the product is defective. This is referred to as the legal guarantee.

After the two-year period, the seller or manufacturer can offer you another commercial guarantee. Check the general guarantee terms and conditions to determine what is covered and the duration of the guarantee.

The seller or manufacturer may choose whether to offer a commercial guarantee. There is no legal obligation to do so.

For second-hand goods, the guarantee period may be shorter, but it cannot be less than one year. Moreover, the seller must clearly inform you of this; otherwise, the guarantee period remains automatically two years.

Hidden Defect

If a hidden defect appears after the two-year legal guarantee period, you can still contact the seller. In that case, however, you must prove that the defect was already present at the time of purchase. You can then only claim a price reduction or refund.
